1. Who you are contracting with
These Terms of Service ("Terms") are a binding agreement between you ("you", "User") and Fd Consult BV, a company organised under Belgian law, registered office de Tilbourgstraat 19, 1981 Zemst, enterprise number BE 0689.803.127, RPR Brussel (Nederlandstalige afdeling) ("Fix My Fit", "we", "us"). Contact: support@fixmy.fit.
By creating an account or using fixmy.fit (the "Service"), you accept these Terms. If you do not accept them, do not use the Service.
2. The Service
Fix My Fit is a software tool that lets you upload cycling videos, runs pose estimation in your browser, computes joint angles, and lets you compare them to reference ranges and share results. The Service is a measurement and visualisation tool. It is not medical advice, not a medical device, and not a substitute for professional bike fitting, coaching, or healthcare. See the Disclaimer.
3. Eligibility
- You must be at least 16 years old.
- You must be legally capable of entering into a contract under your local law.
- The Service is offered to consumers in the EU. Mandatory EU and Belgian consumer protections apply on top of these Terms.
4. Accounts
- You provide accurate registration information and keep credentials secure.
- You are responsible for activity under your account.
- Notify us promptly at support@fixmy.fit of any unauthorised use.
5. Pricing and billing
- Plans. Free tier and paid one-time access as listed at /upgrade. Current pricing: €5 for 30 days of Pro access, or €10 for 365 days of Pro access (incl. VAT where applicable).
- No auto-renew. Paid access is a one-time purchase. It does not renew automatically. When your access period lapses, you return to the Free tier until you purchase again.
- No subscription, no cancellation needed. Because there is no recurring charge, there is nothing to cancel.
- Refunds. We do not refund partially used periods. For unused or accidentally purchased access, email support@fixmy.fit and we'll assess case by case.
- Price changes. Future purchases may be priced differently. Already-purchased access is honored at the price paid.
- Taxes. Prices include applicable EU VAT, collected and remitted by Lemon Squeezy as Merchant of Record.
6. Right of withdrawal (EU consumers)
Under the EU Consumer Rights Directive (transposed in Belgium in Book VI of the Code of Economic Law), as a consumer you have the right to withdraw from a distance contract within 14 days without giving any reason.
The Service involves the supply of digital content/digital services. If you start using the paid Service during the 14-day withdrawal period, you must expressly request immediate performance and acknowledge that you lose your right of withdrawal once performance has begun, in accordance with Art. VI.53, 13° of the Code of Economic Law. We will ask for this confirmation at checkout.
To withdraw before performance begins, send an unambiguous statement to support@fixmy.fit. A model withdrawal form is available on request. Refunds are made within 14 days of receiving the withdrawal notice using the same payment method you used.
7. Acceptable use
You agree not to:
- Upload videos of people who have not consented to being filmed and analysed.
- Upload illegal, infringing, harassing, or sexually explicit content, or content involving minors.
- Reverse-engineer, scrape at scale, or attempt to extract source code or models from the Service.
- Interfere with the Service's operation, probe for vulnerabilities outside an authorised disclosure programme, or use it to attack other systems.
- Resell, sublicense, or operate the Service on behalf of third parties without a written agreement.
- Use the Service to make medical diagnoses or prescribe treatments to others.
We may suspend or terminate accounts that breach this section.
8. Your content and licence
- You own your content. Videos, annotations, and analyses you upload remain yours.
- Licence to us. You grant us a worldwide, royalty-free, non-exclusive licence to host, transmit, transcode, store, and display your content solely to operate the Service for you (including showing it via share links you create). The licence ends when you delete the content or close your account, subject to backup retention.
- No AI training. We do not use your content to train third-party generative AI models.
- You warrant you have the rights to upload the content and that everyone visible in the video has consented to the recording and to its analysis.
9. Sharing
Share links make a single analysis viewable by anyone holding the link. They are unguessable but not authenticated. Treat them like a "view-only" public link. You can revoke any link at any time. Use the mask/blur tool before sharing if the video contains faces or identifying surroundings you do not want public.
10. Our intellectual property
The Service, its software, design, and documentation are owned by Fix My Fit or its licensors and are protected by copyright and other laws. We grant you a personal, non-exclusive, non-transferable right to use the Service in accordance with these Terms. No other rights are granted by implication.
11. Service availability and changes
- We aim for high availability but do not guarantee uninterrupted service.
- We may update, modify, or discontinue features. Material breaking changes will be notified in advance where feasible.
- Planned maintenance may be announced in-app or by email.
12. Statutory warranty & disclaimers
As a consumer, you benefit from the legal conformity guarantee under Belgian law (Books VI and XIV of the Code of Economic Law) and from the rights provided by the EU Digital Content Directive. Nothing in these Terms limits or excludes those mandatory rights.
Beyond mandatory consumer rights, the Service is provided "as is" and "as available". We do not warrant that joint-angle measurements are accurate to any specific tolerance or fit for any particular purpose, including medical, therapeutic, or competitive purposes.
13. Liability
We do not exclude or limit our liability for fraud, gross negligence, intentional misconduct, death or personal injury caused by our negligence, or any liability that cannot be limited under Belgian law.
Subject to the above, our aggregate liability arising out of or related to the Service in any 12-month period is limited to the greater of (a) the fees you paid us in that period and (b) €100. We are not liable for indirect or consequential losses, lost profits, lost data beyond our reasonable backup obligations, or losses caused by your reliance on measurements as medical or professional advice.
14. Termination
- You may close your account at any time from the account page.
- We may suspend or terminate your account for material breach of these Terms or applicable law, with notice where reasonably possible.
- On termination, paid features cease and your data is deleted in line with our retention schedule (see Privacy Policy).
15. Changes to these Terms
We may update these Terms. Material changes will be notified by email or in-app at least 30 days in advance. Continuing to use the Service after the change means you accept the new version. If you do not accept it, cancel before the effective date.
16. Governing law & disputes
These Terms are governed by Belgian law, without prejudice to mandatory consumer protections of your country of residence in the EU.
Disputes are subject to the exclusive jurisdiction of the courts of Brussels (Dutch-speaking division), Belgium, except that consumers may also bring proceedings in the courts of their place of residence as required by EU consumer law.
Consumers may also use the European Online Dispute Resolution platform at ec.europa.eu/consumers/odr or contact the Belgian Consumer Mediation Service (Service de Médiation pour le Consommateur / Consumentenombudsdienst, mediationconsommateur.be).
17. Miscellaneous
- Severability. If a clause is unenforceable, the rest remains in force.
- No waiver. Our failure to enforce a right is not a waiver of it.
- Assignment. You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets.
- Entire agreement. These Terms, together with the Privacy Policy, Cookie Policy, and Disclaimer, are the entire agreement between us.
